Caption: Relating to the amendment of restrictive covenants applicable to certain subdivisions.
Initially Referred to House Trade, Workforce & Economic Development Committee, chaired by a Republican
HB 1006 amends the Texas Property Code to create a framework for amending restrictive covenants in certain multi-zoned subdivisions. It applies to subdivisions platted before 1965 with more than 900 lots, located in at least three counties, and spanning multiple municipalities. The amendments must be approved by 67% of lot owners in the affected subdivision area and recorded in the property records. The bill also prohibits claims against the enforceability of amended restrictions on the basis of non-mutuality.
