HB 413 proposes adding Article 17.1511 to the Code of Criminal Procedure, addressing the detention of defendants awaiting trial. Under this bill, defendants charged with offenses punishable as Class B misdemeanors or higher cannot be held in jail pretrial for longer than the maximum term of confinement applicable to their alleged offense. This calculation includes any credit the defendant could earn for time served while detained. However, the provision does not apply to defendants undergoing competency evaluations or commitment under Chapter 46B. The law would take effect on September 1, 2025, and would apply only to arrests occurring on or after that date.
