HB 1722 amends the Texas Transportation Code to ensure property owners or lessees have access to private property located within a Texas Department of Transportation (TxDOT) highway right-of-way. It prohibits TxDOT from restricting access to such properties if they were constructed before the department assumed authority over the right-of-way and can only be accessed through it. The bill does not prevent TxDOT from acquiring such properties through authorized methods, including purchase or condemnation.
