Caption: Relating to the repeal of the offense of homosexual conduct.
Initially Referred to House Criminal Jurisprudence Committee, chaired by a Republican
HB 1738 repeals Section 21.06 of the Penal Code, which criminalizes homosexual conduct, and amends related provisions in the Health and Safety Code to remove references to homosexuality as unacceptable or criminal behavior. The bill takes effect immediately upon sufficient legislative approval or on September 1, 2025, otherwise.
