Caption: Relating to the renewal and review of standard permits for certain concrete plants.
Initially Referred to Senate Natural Resources Committee, chaired by a Republican
Last Referred to House Environmental Regulation Committee, chaired by a Republican
SB 763 amends the Health and Safety Code to establish a renewal and review process for standard permits related to certain concrete plants. Specifically, it mandates that the Texas Commission on Environmental Quality (TCEQ) conduct a protectiveness review at least once every six years for standard permits authorizing operations of permanent concrete plants, including wet batching, dry batching, or central mixing facilities. The review will evaluate the background concentrations of air pollutants to ensure ongoing compliance with environmental standards. The bill also requires permit applications for such concrete plants to include detailed plot plans that illustrate property lines, emission points, structures, and any required setbacks or buffers. The TCEQ is directed to adopt rules by March 1, 2026, to implement these provisions. Existing authorizations may continue under prior law until their renewal eligibility dates.
