Caption: Relating to common law public nuisance claims.
Initially Referred to Senate State Affairs Committee, chaired by a Republican
SB 779 proposes to amend Title 4 of the Texas Civil Practice and Remedies Code by adding Chapter 100C, which establishes limitations on public nuisance claims under common law. It defines public nuisance claims as those seeking damages, abatement, or other relief related to public nuisances under Texas common law. The bill restricts such claims in cases where the action or condition is authorized by federal or state law, addressed by statutory or administrative mechanisms, or related to products or their manufacturing and marketing. It clarifies that aggregated private nuisances do not constitute public nuisances under this chapter. The new provisions would override conflicting common law principles and would apply to actions filed after the bill's effective date.
