HB 2149 amends the Local Government Code to provide property owners and lessees greater rights when their land use becomes nonconforming due to changes in zoning regulations or boundaries. It requires municipalities to enter into an agreement with property owners or lessees before compelling them to stop nonconforming land use. Such agreements must outline either compensation for costs and market value loss or a continuation period for the nonconforming use sufficient for the owner or lessee to recover these costs through business activities. The bill also establishes new rights, including the ability to resume nonconforming use within five years of stopping it, protections for repair or expansion of nonconforming structures, and declaratory relief for violations. Additionally, it waives municipal immunity in cases involving nonconforming use disputes. The changes apply to zoning considerations or requests made on or after September 1, 2025.
