HB 2180 allows defendants in criminal cases to waive their right to the preservation of evidence and the return of seized weapons after pleading guilty or nolo contendere. The waiver must be in writing and signed with the defendant's counsel. If the court determines the waiver was made voluntarily and intelligently, it can order the disposal of evidence, including weapons, starting 120 days after the order. Defendants may revoke the waiver within that timeframe. Prosecutors are prohibited from making the waiver a condition of plea bargains.
