Initially Referred to House S/C on Family & Fiduciary Relationships Committee, chaired by a Democrat
Last Referred to Senate Jurisprudence Committee, chaired by a Republican
HB 2240 revises Texas marriage laws regarding void marriages. The bill specifies that a later marriage that was void due to an existing prior marriage becomes valid when the prior marriage is dissolved, provided the couple continues to live together and represent themselves as married. However, it allows a "putative spouse" - someone who unknowingly entered into a marriage with a person already married - to file to declare the later marriage void within two years of discovering the prior marriage. Additionally, the bill creates a legal process for declaring a divorce
