Caption: Relating to equitable relief from the enforcement of certain governmental requirements that affect agricultural operations.
Initially Referred to Senate Water, Agriculture and Rural Affairs Committee, chaired by a Republican
Last Referred to House Agriculture & Livestock Committee, chaired by a Republican
SB 1035 proposes to provide equitable relief for agricultural operations affected by governmental regulations imposed by political subdivisions in violation of existing agricultural law. The bill allows an aggrieved person to bring an action against a political subdivision to obtain declaratory or injunctive relief to prevent enforcement of such governmental requirements. If successful, the claimant may recover court costs and attorney fees.
