Caption: Relating to administrative remedies for certain fraud and abuse violations under Medicaid; providing administrative penalties.

SB 1038 enhances administrative penalties and remedies for Medicaid fraud and abuse. It broadens the definition of violations, increases financial penalties, and clarifies that fraud investigations do not require proof of specific intent. The bill introduces whistleblower awards for individuals who report Medicaid fraud leading to financial recoveries. It also expands penalties for kickbacks, fraudulent claims, and misrepresentations in Medicaid billing. Additionally, it strengthens enforcement by allowing the Office of the Inspector General to assess administrative remedies more efficiently and provides protections against wrongful denials of Medicaid services by managed care organizations.
