SB1059

In Calendar Committee in Other Chamber
Authored by Tan Parker (R)

Caption: Relating to the authority of the governing body of a home-rule municipality to submit a proposed charter amendment to the voters for approval if application of the provisions of the amendment would be contrary to state law.
Initially Referred to Senate Local Government Committee, chaired by a Republican
Last Referred to House State Affairs Committee, chaired by a Republican
SB 1059 prevents municipalities from proposing charter amendments that conflict with state law. It amends the Local Government Code to explicitly prohibit home-rule municipalities from submitting proposed charter amendments to voters if implementing the amendment would contradict existing Texas statutes. This measure reinforces state preemption over local governance and limits the ability of municipalities to enact policies inconsistent with state law.
