Initially Referred to Senate Criminal Justice Committee, chaired by a Republican
SB 1124 modifies discovery procedures in criminal cases. It expands the definition of "the state" to include law enforcement agencies and revises rules on the disclosure of evidence to the defense. Prosecutors must disclose information relevant to the credibility of witnesses, especially jailhouse informants. The bill also establishes discovery conferences before trial, allows courts to limit overbroad discovery requests, and sets conditions under which courts can suppress evidence if the state withholds required disclosures.
