SB 40 prohibits political subdivisions from using public funds to pay nonprofit organizations that post bail for defendants. If a political subdivision violates this rule, taxpayers or residents can seek injunctive relief to stop further expenditures and recover attorney's fees if they prevail in court. The bill aims to prevent local governments from financially supporting bail assistance programs.
