Caption: Relating to information regarding perinatal palliative care; creating an administrative penalty.
Initially Referred to Senate Health & Human Services Committee, chaired by a Republican
Last Referred to House Public Health Committee, chaired by a Republican
SB 1233 establishes requirements for informing pregnant women about perinatal palliative care services when their unborn child is diagnosed with a life-threatening disability. The bill mandates that the Texas Health and Human Services Commission develop and maintain informational materials describing perinatal palliative care options, including medical and support services available to pregnant women and their families. The commission must also create a geographically indexed list of perinatal palliative care providers and publish it on its website. Health care providers diagnosing a fetal life-threatening condition must provide pregnant women with these materials and a certification form acknowledging receipt of the information. Providers must obtain a signed certification form from the patient and retain it in their medical records. The bill imposes disciplinary action and administrative penalties on health care providers who fail to comply, including a written warning for the first violation and a $1,000 penalty for each subsequent offense.
