HB 2867 establishes limits on late payment fees charged by municipally owned water utilities for water and sewer services. It prohibits a utility from imposing a late fee before the 32nd day of the penalty period that exceeds $5 or 2% of the past due amount, whichever is greater. After the 32nd day but before the 41st day, the maximum allowable late fee increases to $5 or 5% of the past due amount. After the 41st day but before the 51st day, the late fee may not exceed $5 or 10% of the past due amount. Additionally, the bill requires that a late payment penalty period may not begin before the 21st day after the customer's bill is mailed or transmitted electronically, and it ends once the customer fully pays all past-due amounts.
