Caption: Relating to allowing the governing bodies of certain political subdivisions to call for a local option election relating to the sale of alcoholic beverages.
Initially Referred to House Licensing & Administrative Procedures Committee, chaired by a Republican
Last Referred to Senate State Affairs Committee, chaired by a Republican
HB 2885 grants county commissioners courts and municipal governing bodies in certain counties the authority to call for a local option election on the sale of alcoholic beverages. It applies only to counties with a population between 70,000 and 100,000, that contain a portion of the Colorado River, and that are adjacent to a county with a population of one million or more. Under this bill, a county commissioners court may, on its own motion, order a local option election to determine whether the sale of specific types of alcoholic beverages should be legalized within the county or a justice precinct. Additionally, a municipal governing body may pass a resolution to order such an election within city limits. This bill allows local governments more control over the regulation of alcohol sales in their jurisdictions.
