Caption: Relating to eligibility for a general permit to discharge waste into or adjacent to waters in this state.

SB 1302 amends the Texas Water Code to establish a five-year prohibition on obtaining a general permit to discharge waste into state waters after a permit has been denied or suspended. If the Texas Commission on Environmental Quality (TCEQ) denies or suspends a company's authority to discharge wastewater or other pollutants under a general permit, the company cannot reapply for a general permit until five years have passed from the date of denial or suspension. The bill applies only to denials or suspensions occurring on or after September 1, 2025, ensuring that existing cases are governed by current law.
