Caption: Relating to the retention and preservation of toxicological evidence of certain intoxication offenses.
Initially Referred to Senate Criminal Justice Committee, chaired by a Republican
Last Referred to House Criminal Jurisprudence Committee, chaired by a Republican
SB 1660 strengthens retention and notification requirements for toxicological evidence related to intoxication offenses. Crime laboratories must notify county prosecutors annually about the evidence they hold and the dates when retention periods expire. The bill also clarifies the procedures for the destruction of toxicological evidence, requiring written approval from prosecutors for felony cases while streamlining the process for misdemeanor cases. The law applies to evidence with retention periods expiring on or after the bill's effective date of September 1, 2025.
