HJR 7 proposes a constitutional amendment to dedicate a portion of state sales and use tax revenue to the Texas Water Fund, which is used to finance water infrastructure and conservation projects across the state. Under this amendment, in each state fiscal year, the comptroller of public accounts would deposit sales tax revenue exceeding $48 billion into the Texas Water Fund, up to a maximum of $1 billion per year. The Texas Legislature would have the authority to increase or decrease the amount deposited through a two-thirds vote in both chambers. However, adjustments could not exceed 100% of the set deposit amount or reduce it by more than 50%. The automatic deposits would expire on August 31, 2035, unless the legislature extends the provision in 10-year increments through a majority vote. If approved by the legislature, the proposed constitutional amendment will be placed on the November 4, 2025 ballot for voter approval and would take effect on September 1, 2026.
