This bill would cost taxpayers $8,400,000.00 over five years, according to the Legislative Budget Bureau.
HB 4044 modifies provisions of the Texas Tax Code related to certain expenditures by public institutions of higher education and university systems that are eligible for specific tax credits. The bill amends Section 172.102(b) of the Tax Code to allow depreciation and tax-exempt use provisions under federal law to apply to costs and expenses incurred by institutions of higher education or university systems, making these expenses eligible for tax credits. However, this provision is set to expire on January 1, 2035, after which only entities exempt from federal income tax under Section 501(a) of the Internal Revenue Code will qualify. The changes apply only to costs incurred on or after the bill's effective date.
