Caption: Relating to the sealing of certain documents alleged to contain trade secrets.

HB 4081 sets new procedures for sealing court documents that allegedly contain trade secrets. The bill requires any party seeking to seal such documents to file a notice and affidavit with both the trial court and the Texas Supreme Court, providing a general description of the information, the basis for the trade secret claim, and contact information for future motions to unseal. If a document is submitted under seal without the required affidavit, it will be treated as a public record unless an affidavit is filed within 14 days. The bill also allows any person to intervene at any time to seal or unseal documents and grants courts ongoing jurisdiction to rule on such matters. If challenged, the party seeking to maintain the seal must prove by a preponderance of the evidence that the document qualifies as a trade secret. The bill is designed to standardize the process of protecting sensitive business information in legal proceedings.
