SB 2052 amends the Family Code to establish a rebuttable presumption that a parent acts in the best interest of their child in custody disputes between parents and nonparents. A nonparent must prove by clear and convincing evidence that denying their request for custody would significantly impair the child's physical health or emotional development. The bill also applies this presumption to modification suits unless a prior order has already rebutted it.
