Caption: Relating to the regulation of emissions by the Texas Commission on Environmental Quality during an event affecting electric demand or grid reliability.

SB 2321 grants the Texas Commission on Environmental Quality (TCEQ) the authority to waive enforcement of emissions limits for power plants and backup generators during electric grid emergencies. If ERCOT declares an emergency due to a reliability or demand issue, TCEQ must suspend enforcement of emissions-related penalties for the duration of the event. Operators of affected facilities must maintain records of their emissions, but exceedances will not be subject to enforcement actions unless the operator fails to submit the required documentation.
