HB 5115 proposes to increase the penalties for the crime of election fraud under the Texas Election Code. It amends Sections 276.013(a) and (b) to redefine election fraud offenses and upgrades the offense from a Class A misdemeanor to a second-degree felony. The bill also stipulates that if the offense is committed by an elected official, it will be classified as a first-degree felony. Additionally, an attempt to commit election fraud would be reclassified from a Class B misdemeanor to a third-degree felony.
