HB 5147 updates the state's investigational stem cell treatment laws to ensure compliance with FDA manufacturing standards. The bill modifies the definition of investigational stem cell treatment to require the use of adult stem cells produced under the FDA's current good manufacturing practices. It expands the types of medical facilities authorized to administer investigational stem cell therapies, allowing treatments to be provided at hospitals, ambulatory surgical centers, medical schools, and outpatient settings with Level II anesthesia capabilities. Institutional review boards overseeing these treatments must be affiliated with accredited medical institutions or approved by national health regulatory organizations. The Texas Health and Human Services Commission is required to develop a standardized informed consent form notifying patients that investigational treatments have not been FDA-approved.
